I. INTRODUCTION

This is an action brought by plaintiff Equal Employment Opportunity Commission (“EEOC”) pursuant to Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e, et seq. The EEOC alleges that defendant Switching Systems Division of Rockwell International Corporation (“Switching”) violated Title VII by discriminating against Hispanics and other non-American-born employees on the basis of their national origin.
