MILBURN, Circuit Judge.

Plaintiff J.Z.G. Resources, Inc. appeals the district court’s, grant of summary judgment in favor of defendant Shelby Insurance Company in this action to recover, under a general liability insurance policy issued by defendant, for property damage sustained by plaintiff that was caused by defendant’s insured. On appeal, the issue is whether the district court erred in granting summary judgment in favor of defendant on the ground that a prior action between the parties in New York precluded plaintiffs present action. For the reasons that follow, we affirm.
