CALHOUN, Judge.

The offense, transporting intoxicating liquor; the punishment, one year in the penitentiary.

The evidence in brief showed that' the appellant and others on or about December 24, 1931, were pitching washers, commonly called “pitching dollars,” in the town of Timpson near the rear of the postoffice, and there was a large crowd watching the game. A constable by the name of Elmer Nichols had his attention attracted, and he went over to where the appellant and others were engaged in pitching washers, and he noticed that the appellant was drunk.
