Appellant, George J. Thomas and Mike Camebolis were indicted on three counts for violation of the Jones-Miller Act.1 The first count charged that, on June 17, 1938, defendants fraudulently and knowingly imported 88 ounces of smoking opium into the United States contrary to law; the second *930count charged that, on the same date, defendants fraudulently and knowingly facilitated the transportation of 46 ounces of smoking opium which had been imported into the United States contrary to law; and the third count charged that on the same date, defendants fraudulently and…
