Affirming.

On Angnst 17, 1928, tbe appellants, J. C. Miller and W. W. Damron, partners doing business under tbe firm name of Miller & Damron, sold to tbe Three Sands Oil Company an undivided one-tbird interest in an oil and gas lease for tbe sum of $36,000. Tbis is an appeal from a judgment of tbe Daviess circuit court awarding .appellee $1,080 as a brokerage commission on tbe sale.
