PATTERSON, Judge.

¶ 1 Kevin Lewis McDonald (defendant) petitions this court to review the summary dismissal of his petition for post-conviction relief. We grant review and for the reasons stated deny relief.

PROCEDURAL BACKGROUND

¶ 2 Defendant was convicted of aggravated assault, a class three dangerous felony. The court found that defendant had committed the offense while on probation.
