'HANEY, Circuit Judge.

Appellant was convicted on the fourth, fifth, sixth, and seventh counts of the indictment and appealed. The fourth and fifth counts charged violations of 26 U.S. C.A. § 1182; the sixth count charged violation of 26 U.S.C.A. § 1441; and the seventh count charged violation of 26 U.S.C.A. § 1440.

Witness Harkins, an investigator for the government, testified that on September 10, 1935, he placed under observation certain premises in Millbrae, San Mateo county, Cal.; that he saw a car being driven into the garage of the premises; that at the time the car “was high on the…
