THIS MATTER comes before the Court on defendant’s motion to dismiss or, in the alternative, to stay this case pending resolution of a parallel proceeding in Alaska state court, docket no. 8. This motion presents an issue previously unaddressed in the Ninth Circuit: whether a district court should exercise its discretion to entertain actions under the Declaratory Judgment Act involving both federal maritime and state law concerns.
