This is an action for the alleged wrongful death of Matthew Holden, brought by his widow, as administratrix of his estate. The jury found for defendants, who appeal from the order granting a new trial.
Holden died as the result of injuries sustained in an automobile collision which occurred shortly after 1:30 o ’clock on Sunday morning, August 11, 1940, on Illinois State Highway No. 4. He was one of four occupants of a Ford ear being driven by Stanley Best.
