David L. Davis, Jr. (“Appellant”) appeals his conviction by a jury of one count of the class C felony of possession of a controlled substance, a violation of section 195.202. 1 Following his conviction, Appellant was sentenced by the trial court to five years in the Missouri Department of Corrections. In his sole point on appeal, Appellant maintains the trial court erred in overruling his motion for judgment of acquittal because the evidence was insufficient to prove beyond a reasonable doubt that he was in possession of a controlled substance.
