This matter is before the Court on the Motion to Dismiss (docket no. 38) pursuant to Federal Rule of Civil Procedure 12(b)(6) jointly filed by Defendants Anthem Health Plans of Virginia, Inc. (“Anthem”), Employees Group Health Plan of Commercial Glass & Plastics (the “CGP Group Health Plan”), Commercial Glass & Plastics, Inc. (“CG & P”), and John M.
