Rand, J.), entered on or about December 18, 2003, which adjudicated appellant a juvenile delinquent upon a fact-finding determination that he committed an act which, if committed by an adult, would constitute the crime of resisting arrest, and conditionally discharged him for a period of 12 months, unanimously reversed, on the law, without costs, the finding of juvenile delinquency and order of conditional discharge vacated, and the petition dismissed.
