DUBINA, Circuit Judge:
In Case No. 91-7358, Sears, Roebuck & Company (“Sears”) appeals the district court’s order denying Sears’ motion for reconsideration of the denial of summary judgment on the issue of whether Vernal Forbus, Earl J. Beacham, Rudolph Caddell, Frank R. Davis, and Vernie Rhodes, Jr. (collectively referred to as “the Retirees”), have waived suit against Sears pursuant to releases they executed upon retirement.
