STATEMENT OF THE CASE

RATLIFF, Chief Judge.

Norman Ivey appeals the summary judgment for Massachusetts Bay Insurance Company ("MBIC"), which dismissed Ivey's action for declaratory judgment for rights under an insurance policy. We affirm.
