Appeal from a judgment of the County Court of Columbia County (Leaman, J.), rendered July 9, 1998, upon a verdict convicting defendant of the crimes of sexual abuse in the first degree (two counts) and endangering the welfare of a child.

Defendant was charged with endangering the welfare of a child (Penal Law § 260.10) in Justice Court of the Town of Hillsdale, Columbia County. Upon the withdrawal of this charge by the People on March 18, 1998 at Justice Court, an Assistant District Attorney orally informed defendant and his counsel that felony sex abuse charges would be presented…
