KANNE, Circuit Judge.
This appeal requires that we determine whether the district court abused its discretion in denying a motion for attorney fees under the fee-shifting provision of the Equal Access to Justice Act (“EAJA”), 28 U.S.C. § 2412(d)(1)(A). The district court determined that the government’s position in this litigation was substantially justified, and be cause we find this decision to have been a proper exercise of discretion, we affirm.
