This suit involves the right to the collection of the penalty denounced by the statute for the railroad company’s failure to pay its delinquent road taxes for the years 1922 and 1923.'
This case is related to that of Wallace v. K. C. S. Ry. Co., 169 Ark. 905, 279 S. W. 1, in which the validity of the three-mill road tax levied by Sevier County for the years 1922 and 1923 was upheld.
