This appeal brings to us for review the indictment, trial, and conviction of Walter Dewberry of the charge of willful murder alleged to have been committed in Hardin county, Ky., by the shooting and killing of Thomas Tillery on. the 8'th of April, 1931. He was convicted by a verdict] of the jury and his punishment fixed at death, and from the judgment sentencing him, he appeals. ,
