Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered October 10, 2000, convicting defendant upon his plea of guilty of the crime of burglary in the second degree.

*764In a six-count, superseding indictment dated June 27, 2000, defendant was charged with two counts of burglary in the second degree, two counts of petit larceny, grand larceny in the fourth degree and burglary in the third degree.
