Appeal from a judgment of the County Court of Schenectady County (Eidens, J.), rendered July 16, 2004, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the fifth degree.

Defendant was charged in a superior court information with criminal possession of a controlled substance in the fifth degree after he was found in possession of 17 bags of cocaine.
