HAWTHORNE, Justice.
The Court of Appeal affirmed a judgment of the district court awarding to plaintiff Thomas H. Sumrall compensation for total and permanent disability but denying penalties and attorney’s fees claimed under R.S. 22:65s. 1 This court granted a writ to review the judgment of the Court of Appeal only insofar as it denied penalties and attorney’s fees.
