POWELL, Judge.

This is an appeal by the State from an order of the district court of Choctaw County having the effect of setting aside the information filed against E. L. Dickson, charged with the crime of fraudulent branding of a certain heifer, alleged to be the property of James Manar.

The information had been filed in the district court of Choctaw County, and the defendant filed a motion to set aside the information and dismiss, based on the ground that the crime was charged as having been committed on May 15, 1956, but that the information had not been filed in the district court until…
