Chase Manhattan Bank (hereinafter “Plaintiff”) has brought an adversary complaint against Debtor Dale Weiss (hereinafter “Debtor”) under 11 U.S.C. § 523(a)(2) to determine dischargeability of debt arising from the use of a credit card. Plaintiff is owed, as of the October 7, 1991, filing date, $5,055.66 for prepetition credit card transactions that occurred after Debtor’s spouse ceased to be employed. Debtor denies making the transactions with the intent not to pay for them. On April 23, 1992, a trial was held and the Court took this matter under advisement.…
