(After stating the foregoing facts.) It appears from the evidence that the plaintiff and the defendant were adjoining land owners, and that the tract of land from which the timber in question was cut consisted of four or five acres. The plaintiff acquired his land, consisting of a tract of thirty-seven acres, more or less, from his father, G. L. Price, who inherited it from his father, W. D. Price, and W. D.
