The Plaintiff Susan Rozek (“the Plaintiff’) brings this action under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq., against the Defendants New York Blood Center (“NYBC”), NYBC in its capacity as Plan Administrator of NYBC, and First Unum Life Insurance Company (“First Unum,” and collectively, “the Defendants”).
