Merrill, J.:

This is an action upon a contract of insurance. Respondent was the plaintiff below; appellant was the defendant. The parties will be so designated in this opinion.

On February 16, 1949, plaintiff’s automobile was damaged in an upset. The car was covered against such injury by a contract of insurance between plaintiff and defendant company.'
