Appeal from a decree of the Superior Court of the city and county of San Francisco distributing the estate of a deceased person, and from an order refusing a new trial. The facts are stated in the opinion.

After a more mature consideration of this appeal, upon rehearing,, we are satisfied that the court below was in error, and that the decree appealed from must be reversed.

The appeal is taken by William E. Miller, assignee of William W. Richards, from a decree of distribution, by which the estate of the deceased was distributed, one half to her mother, Mary A. Strasberger, and the other half to Theodore T. Cook, who was adjudged to be the surviving husband of the deceased.
