RITCHIE, District Judge.

The plaintiff, who is the appellant, appeared in this action against the defendant and respondent to enjoin him from conveying water through a certain ditch running across the plaintiff’s land, and to recover damages caused by the overflow of water running through the ditch. For convenience, their names will be used in discussing the facts instead of designating them as appellant and respondent respectively.
