This case arose as a suit on account in a justice’s court, the articles alleged to have been sold by the plaintiff, Drake, to the railroad company being two lots of cross-ties, one on December 15, 1913, the other on March 30, 1914, at prices therein stated. The defendant denied that it was indebted to the plaintiff in any amount or manner. Dpon the trial in the justice’s court the magistrate rendered judgment in favor of the plaintiff, for the full amount claimed.
