Before Hudson, J., Spartanburg, September, 1886. This was an action by John J. Brown against Jessie M. Thomson, commenced January 13,1886, on an account for goods sold in the years 1883 and 1884. A bill of particulars was served, giving items of account, some of which appeared to have been delivered to the husband of the defendant, and some to her children. The action below was brought on an open account, alleged to have been contracted by the defendant with the plaintiff for certain goods, wares, and merchandise furnished by plaintiff to said defendant. The account may be divided into two parts, the first, embracing certain articles for the use of the defendant, her husband and her children, and the household ; the second, certain articles for the use of the separate estate of the defendant.
