This matter is before the Court on Defendant Southern Bank and Trust’s (“Defendant”) motion to dismiss certain allegations in Count One of Stoney Glen, LLC, John P. Wright, and Allen 0. Keene’s (collectively, “Plaintiffs”) Amended Complaint. Docs. 24, 25; see also Doc. 20 (“Am. Compl.”). Specifically, Defendant argues that Plaintiffs have inadequately pleaded a breach of the implied duty of good faith and fair dealing as a basis for a breach of contract claim. Doc. 29.
