MEMORANDUM OPINION

SMALKIN, District Judge.

This action is before the Court on the defendants’ motion for summary judgment and the plaintiffs cross-motion for partial summary judgment with respect to liability. Neither side requested a jury trial. The issues have been fully briefed, and no oral hearing is necessary. Local Rule 105.6.
