OPINION

BARKER, Judge.

¶ 1 The Arizona Department of Economic Security (“ADES”) appeals the juvenile court’s order denying termination of Matthew L.’s parental rights to his son, S.L. Finding no error, we affirm.

Facts and Procedural History

¶ 2 On September 17, 2007, Matthew was sentenced to 3.5 years imprisonment after he was convicted of attempted possession of narcotic drugs for sale, a felony. While Matthew was incarcerated, S.L. was born on January 16, 2008.
