The testator died in the city of Hew York in 1874, without descendants. The controversy in both actions arises because of the death of Stephen Jay Thompson in 1897, of full age, without widow or issue surviving him, leaving a will which has been duly probated, by which he gave all his property to his mother, the Josephine L. Thompson mentioned in the third article of William D. Thompson’s will. Josephine L. Thompson is still living. William D.
