In this case, plaintiff Andrew S. Prousi (hereinafter “Prousi”) has brought warranty claims against defendants Cruisers, a Division of KCS International, Inc. (“Cruisers”) and Crusader Marine Engines (“Crusader”) in connection with plaintiffs purchase of a yacht manufactured by defendant Cruisers. Cruisers has moved for summary judgment. 1 Plaintiff has invoked diversity jurisdiction; however, as will be clear from the discussion below, plaintiffs claims under the federal Magnuson-Moss Warranty Act would support federal question jurisdiction in any event.
