delivered tbe opinion of the court:

This case comes to the court by Congressional reference. It concerns damages (loss of life, personal injury, and property damage) resulting from the explosion of a munitions truck on a public highway in North Carolina in 1942. There are more than 200 plaintiffs.

The matter is presently before the court pursuant to an order directed to defendant to show cause why the Government’s contention relating to the interpretation of Rule 26, containing discovery procedures, should not be overruled. Specifically, the rule directs the defendant to show…
