Atkinson, Presiding Justice.

The plea and answer of the defendant Willie B. Rainey alleging that she ivas the common-law wife of Hinton Rainey, and lived with him as such both in Georgia *715and in the District of Columbia, did not authorize the court, on motion of the plaintiffs, to require her to make an election as to whether she would prove her common-law marriage under the laws of Georgia or under the laws of the District of Columbia. McClellan v. McClellan, 142 Ga. 322 (82 S. E. 1069).

The evidence did not demand, as contended by the defendants in error, a verdict in favor of the defendants.
