(After stating the foregoing facts.) The accusation in this case is based on the 1947 Cumulative Pocket Part of the Code Supplement, § 58-726, as follows: “No person, firm or corporation shall sell, offer for sale, or possess for the purpose of sale, any of the malt beverages specified and legalized by this Chapter, without first having obtained a license to deal in such beverages under the provisions of this Chapter, and any person, firm or corporation guilty of violating the provisions of this section shall be guilty of a misdemeanor and punished as provided in this Chapter.” (Ga.
