MEMORANDUM AND ORDER

HARMON, District Judge.

Pending before the Court are Defendant’s motion for leave to file a motion for summary judgment (Doc. 31) and motion for summary judgment (Doc. 32). Defendant’s motion for leave is GRANTED. For the reasons set forth below, Defen dant’s motion for summary judgment is GRANTED-IN-PART and DENIED-IN-PART.
