The appellee, Hawving, sued the appellant, Woodrow, in the justice court, and recovered a judgment for one hundred dollars.. The defendant appealed to the circuit court, where the case was tried dc novo by the court without the intervention of a jury, and the court rendered judgment for the plaintiff for the amount of the judgment recovered in the justice court, and interest thereon as damages. The rule is, that when a case is tried by the court, without a jury, although the trial court may have erred in the admission of evidence, yet if the judgment is sustained by all the legal evidence,…
