Order, Supreme Court, New York County (Ira Gammerman, J.), entered on or about April 14, 1992, which, inter alia, denied the motion by defendant Guttman Breast Diagnostic Institute ("the Institute”) to dismiss all claims for any negligence occurring prior to August 11, 1988 as time barred, unanimously modified, on the law, only to the extent of denying the motion as a matter of law and as so modified, the order is otherwise affirmed, without costs.
