Defendant, Dennis Baker, was charged in the district court of Mayes county with the crime of assault with a dangerous weapon, was tried, convicted and sentenced to1 serve a term of two years in the State Penitentiary, and has appealed.

For a reversal of this case it is contended that the evidence offered by the state was insufficient to sustain the judgment and sentence; that the court erred in admitting incompetent, irrelevant and immaterial evidence; and that the court should have granted a new trial by reason of newly discovered evidence presented at subsequent motion for new trial.
