Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered September 11, 1996, which revoked defendant’s probation and imposed a term of imprisonment.

While serving a five-year term of probation for felony driving while intoxicated, defendant was charged with violating the terms of his probation after a police officer observed him driving a vehicle. A plea agreement was reached wherein defendant agreed to plead guilty to the probation violation in exchange for a sentence of 15 days in jail and continued probation.
