Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found that petitioner violated certain racing regulations.

Mark’s Minor, a thoroughbred racehorse trained by petitioner, finished in second place in the second race at Saratoga Race Course in Saratoga County on August 2, 2000. A urine sample taken from the horse 38 minutes after the race tested positive for the proscribed substance lidocaine. Petitioner was fined $1,000 and suspended for 15 days. Upon administrative…
