Rudolph G. Giesler and Emma >L. Beirhaus were married in 1895, and resided in the City of Chicago, Ill., throughout coverture. They separated in 1914, and in 1917 were divorced, at the instance of Mrs. Giesler. One child, a daughter, was born of this union, and is still living. Giesler removed to Texas after the divorce, and resided there until his death in 1923. Mrs. Giesler married E. W. McClave in 1919, but will be referred to herein as Mrs. Giesler, or defendant in error.
