NOTTINGHAM, District Judge.
This is a civil-rights action. On January 4, 1999, two-year-old Kayanna Pierce died from injuries allegedly inflicted by her mother’s live-in boyfriend, Jeremiah Duran. Plaintiffs Victor J.
