Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Commissioner of Environmental Conservation which (a) denied certification of a proposed hydroelectric generating project pursuant to section 401 of the Clean Water Act, and (b) denied petitioner’s application for a State Pollutant Discharge Elimination System permit pursuant to ECL article 17.
