Suit was commenced by appellee against the Mariner Baking Company, an Illinois corporation, in April, 1932. Praecipe for summons was filed by plaintiff directing the clerk to issue summons in the case against the Mariner Baking Company, to the damage of the plaintiff of $5,000. Pursuant thereto, summons was issued under date of April 22, 1932. This summons was returned by the sheriff showing service on the defendant through George Mariner, vice-president.
