We granted certiorari in this case to determine whether “in life” photographs, depicting a homicide victim while the victim was alive, may be displayed to the jury at trial.

On April 25, 1993, Respondent Paul Everett Broberg was driving along a two-lane road in Frederick County. The posted speed limit was fifty miles per hour. As Broberg drove over the crest of a hill, he struck and killed eleven-year-old Thomas Blank, Jr., who was driving a tractor across the road.
