MARTIN, Chief Justice.

This is an appeal from a decision of the Commissioner of Patents, aflmming a decision of the Examiner of Interferences, whereby an application of the appellee for the registration of a trade-mark was granted, and the opposition of the appellants was dismissed.

The mark sought to be registered comprises the word “Tech,” printed in white script letter? across a plaid background, as a trade-mark in the sale of -tobacco in various forms, particularly stogies.
